Abstract
This presentation analyzes the New York Rules of Professional Conduct and their application in the modern legal landscape. The core of this work is a detailed study of ethical failures and implications, specifically focusing on how poor supervision (Rules 5.1 and 5.3) and the unauthorized practice of law (Rule 5.5) can shatter a firm’s integrity. Through an extensive hypothetical situation, I examine how the breaking of these ethical rules leads to breaches in competence and client communication.
A significant portion of the analysis addresses Rule 1.6 (Confidentiality) in the digital age. I highlight the risks of using non-secure AI tools for sensitive case notes, which can lead to data leaks and the loss of attorney-client privilege. These theoretical risks are contrasted with insights from an interview with a practicing attorney, who explains how AI has become an essential tool for certain kinds of attorney work. By combining a strict ethical rules analysis with real-world perspectives, this presentation explores the challenge of maintaining high standards of diligence and candor in a profession rapidly influenced by technology.
